By creating an account on Sellpher, you agree to these Terms of Service. If you do not agree, do not use the platform.
Sellpher is a creator marketplace that connects brands with content creators. Brands post campaigns and pay creators for content. Sellpher acts as an intermediary and escrow service.
You must: • Provide accurate information when registering • Be at least 18 years old • Keep your password secure • Not share your account with others • Not create multiple accounts to abuse the platform
By posting a campaign you agree to: • Pay the full campaign budget before the campaign goes live • Review creator submissions within 14 days • Provide honest feedback when declining proposals • Not use creator content without paying or completing payment • Not contact creators outside the platform to avoid fees Brands who use creator content without paying will be permanently banned and may face legal action.
By submitting a proposal you agree to: • Only submit original content you own the rights to • Not submit content that violates third-party rights • Post content on your own social media after acceptance • Submit the live post URL within 7 days of acceptance • Not submit the same content to competing brands simultaneously
Sellpher charges: • Brands: platform fee on campaign budget, which varies by subscription plan (10% on the free plan, reduced to 6% and 3% on paid plans) • Creators: 20% withdrawal fee (15% for verified creators) All amounts are in USD. Payments are held in escrow and released only when brands approve content. Sellpher reserves the right to update fees with 30 days notice.
Campaign funds are held in escrow by Sellpher until they are released to creators or refunded to the brand. Unspent budget is refunded to brands automatically, with no manual request required: • Deal and contest campaigns: any budget not paid to creators is refunded after the campaign deadline. • CPM campaigns: any unspent budget is refunded after each submission's tracking window ends and the campaign settles. The platform fee is non-refundable once a campaign has received at least one creator application, because the platform has delivered creator distribution and matching. A campaign cancelled before it receives any applications is refunded in full, including the platform fee. Refunds are credited to the brand's Sellpher wallet balance, not returned to the original payment method. Brands withdraw their wallet balance to their bank via Stripe or Paystack. Once a brand approves a creator's live content, that payment is final and is not refunded. If a brand does not review a creator's live submission within 48 hours of posting, payment is automatically released to the creator. Retainer payments are held in escrow. After a creator delivers a retainer video, the brand has 48 hours to approve; absent approval or a dispute, the payment is automatically released to the creator. Either party may open a dispute before release, which pauses the payment for Sellpher support review; disputes are resolved by releasing the payment to the creator or refunding the brand (platform fee retained). Creators retain ownership of their content until payment is released. Upon payment: • Brand receives a non-exclusive license to use the content • Creator may still use the content on their own channels • Brand may use content in paid advertising Sellpher does not claim any ownership of creator content.
Sellpher provides AI-powered tools, including the AI Video Scanner, the AI Ad Scanner, and an AI support assistant. • The AI Video Scanner provides automated estimates of a video's potential performance. These scores and suggestions are predictions for guidance only. They are not guarantees of views, engagement, earnings, or campaign acceptance. You are responsible for the content you post. • The AI Ad Scanner analyzes a brand's ad creative and copy to estimate performance potential and to flag possible policy or compliance risks before you spend. These scores and suggestions are predictions and guidance only. They are not guarantees of ad performance, of approval by any advertising platform, or of any outcome. Brands are responsible for their own ad compliance. • The AI support assistant provides automated help and general information. It is not professional, legal, or financial advice, and its responses may contain errors. For account-specific or urgent issues, contact our support team. You agree to use these features lawfully and not to misuse, reverse-engineer, or attempt to overload them.
Users must not: • Circumvent the platform to avoid fees • Post false, misleading, or fraudulent content • Harass or abuse other users • Upload content that violates copyright or community standards • Use the platform for money laundering or illegal activities
If a dispute arises between a brand and creator: 1. Both parties should attempt to resolve it through messaging 2. If unresolved, contact support@sellpher.com within 14 days 3. Sellpher will review evidence from both parties 4. Sellpher's decision is final Sellpher reserves the right to refund, withhold, or release funds based on our investigation.
Sellpher may suspend or terminate accounts that: • Violate these terms • Engage in fraudulent activity • Receive multiple legitimate complaints Users may delete their account at any time from Settings. Pending payments will be processed before deletion.
Sellpher is not liable for: • Actions of brands or creators on the platform • Content quality or performance • Technical issues beyond our control • Indirect or consequential damages Our total liability is limited to fees paid in the 3 months prior to the claim.
These terms are governed by applicable law. Any disputes will be resolved through binding arbitration rather than court proceedings where permitted by law.
